| | | SYNOPSISIn 2017, the International Law Commission (ILC) decided to include “general principles of law” in its long-term programme of work. Since then, the ILC has produced three reports on the topic and a set of draft conclusions. Alongside, or perhaps as a result of, this work by the ILC, there has been an increase in the level of academic attention given to these norms. In my view, this heightened academic engagement was much needed. The theoretical foundations of general principles of law and their role(s) in the international legal system have traditionally been underexplored. In this presentation, I will explain some of the key findings of the ILC in its work on general principles, raise some further questions, and offer some thoughts on the future of these norms in international law.
