Revisiting Anti-Bartlett Clauses in Light of Zhang v. DBS

 

 

SYNOPSIS

This seminar examines the Hong Kong Court of Final Appeal's decision in Zhang Hong Li v DBS Bank in particular whether  trustees  owe a “high level supervisory duty” with respect to the underlying company’s investments, where supervisory duties are excluded under an “anti-Bartlett” clause. The session will be led by Professor Tang Hang Wu, followed by a panel discussion amongst our expert guest speakers moderated by Edmund Leow, S.C.."

ABOUT THE SPEAKER

 

Professor Tang Hang Wu
Professor of Law
Singapore Management University School of Law

Tang Hang Wu is a Professor at the School of Law, Singapore Management University where he directs the Centre for Cross-Border Commercial Law in Asia.    His research interests include land law, restitution, equity, trusts, charity and non-profit law.  Hang Wu has published widely and his work has been relied on by all levels of the Singapore courts, the Royal Court of Jersey, the Caribbean Court of Appeal, the Federal Court of Malaysia and law reform committees in the Commonwealth.   In his capacity as a consultant at TSMP Law Corporation where he co-heads the Trusts & Wealth practice, Hang Wu has advised members of the legal profession in Singapore and Malaysia, international banks, trust companies, the United States Department of Justice and Singapore statutory boards. Hang Wu is frequently instructed as Counsel by other practising lawyers to argue difficult cases before the Singapore Court of Appeal and act as an expert witness on complex Singapore legal issues arising from domestic and international litigation.
