SYNOPSIS
Parties to a contract are generally free to vary its terms. They sometimes impose requirements to be fulfilled before such a variation is said to be effective. A common example is the insertion of a requirement that any variation has to be in writing, the consequences of which were examined by the Court of Appeal of Singapore in a pair of recent cases: Charles Lim Teng Siang v Hong Choon Hau [2021] SGCA 43 and Ma Hongjin v SCP Holdings Pte Ltd [2020] SGCA 106.
This webinar discusses the court’s reasoning and conclusions, as well as their practical impact on contractual variations from drafting and advisory perspectives. A comparative survey of authorities in other common law jurisdictions will also be offered.
SPEAKER
Kwan Ho is an Assistant Professor of Law at the Yong Pung How School of Law, Singapore Management University (SMU). Prior to joining SMU, he practised in the mergers & acquisitions department of a major Singapore law firm and was a Justices’ Law Clerk with the Supreme Court of Singapore.
Kwan Ho is presently also the Deputy Director of the Centre for Commercial Law in Asia, with teaching and research interests in contract law and private law. His work, published in journals including the Cambridge Law Journal, the Law Quarterly Review and the Modern Law Review, is cited by courts in Singapore and Hong Kong, by sitting Singapore and English judges, by regulatory bodies and in academic treatises and articles regularly. He has given expert evidence on Singapore law in foreign court proceedings. Read more here.

b. Group Registration
Registration fee of S$74.90* (inclusive of GST) applies if there are at least 10 participants from the same organisation.
c. SMU Alumni (LLB / JD / LLM graduates)
Registration fee of S$74.90* (inclusive of GST) applies for SMU LLB/ JD/ LLM Alumni per module
*Please note that there will be no refund of any fees should the participant cancel the registration/ fail to attend the event. However, registration is transferable. Notice of any change in participant should be sent to the Academy via email: smulawacademy@smu.edu.sg, by 16 September 2022.
