The prevention of unjust enrichment as an independent legal principle, capable of founding causes of action, gained currency as an independent branch of the common law in England and Singapore only as recently as in the 1990s. Since then, the law of restitution has become an important feature of commercial law, and the Singapore courts have in recent times considered unjust enrichment/restitution claims in many decisions.
Mastery of the key concepts underlying the law of restitution will therefore be of great value to legal professionals engaged in a variety of domains of commercial law. This Primer Series on the law of restitution, taught by a leading expert in this area of law, will be of particular interest to litigation lawyers and in-house counsel, especially those from banks and financial institutions who encounter claims in unjust enrichment that affect their clients or companies.
This series of seminars will introduce participants to the central concepts and disputes in the law of restitution, focussing on unjust enrichment as the organising theme. The topics covered in the series will include the following:
- The elements of a cause of action in unjust enrichment.
- Unjust factors such as mistake and failure of consideration.
- Defences to a claim in unjust enrichment.
