SYNOPSIS


The law of equity and trusts permeates various aspects of legal practice. Beyond the area of private client, the concept of trust is increasingly present in business transactions and takes center stage in many property disputes. The increasing intersection between trust law and other major areas of the law, such as contract, property and corporate laws, further cements its practical importance. Do cryptocurrency exchanges hold cryptocurrency on trust for their clients? Do retail stores hold supplied goods on trust for their suppliers? Why does it matter? Not having a basic foundation of trust law essentially means losing sight of half of private law.


The goal of this two-part seminar series is to provide participants with a basic overview of trust law, focusing more on the frequently arising issues, so that they will learn to identify trust issues and devise appropriate solutions.

Seminar 1: Express Trusts


  • The concept of trust and its basic requirements
  • Basic requirements: three certainties, formalities and constitution
  • Breach of Trust: personal and proprietary remedies; third party liabilities for dishonest assistance and knowing receipt

Seminar 2: Trusts Imposed by Law & Remedies


  • Resulting and constructive trusts
  • Ascertainment of equitable interests in jointly purchased property


 


SPEAKER


Alvin See is an Associate Professor of Law (Education) and Associate Dean (Undergraduate Curriculum & Teaching) at the School of Law, Singapore Management University (SMU). He teaches the Law of Property, the Law of Equity and Trusts and Business Law. He researches mainly on private law, particularly property, trust, unjust enrichment and remedies, and dabbles in animal law. His published works, which appear in leading journals, have been cited by the highest appellate courts in Singapore and Malaysia as well as important treatises on private law. In 2020 he appeared as amicus curiae in the Singapore Court of Appeal and provided expert opinion on a land law dispute. In recognition of his excellence in teaching and research, he was the recipient of the university level Excellent Teacher Award and the Lee Kong Chian Fellowship.

Seminar fee of S$214* (inclusive of GST) applies.

Seminar fee of S$192.60* (inclusive of GST) applies if there are at least 10 participants from the same organisation.

Seminar fee of S$192.60* (inclusive of GST) applies for SMU LLB / JD / LLM Alumni

 


*Please note that there will be no refund of any fees should the participant cancel the registration/ fail to attend the seminar. However, registration is transferable. Notice of any change in participant should be sent to the Academy via email: smulawacademy@smu.edu.sg,by 7 May 2021.


 


SMU School of Law reserves the right to cancel or postpone any event. In such case, we will arrange for the refund of fees paid.
