LAW643 Cross-Border Mediation:  Professional Skills and Practice

 

   

The Singapore International Dispute Resolution Academy (SIDRA) and SMU Law Academy (SMULA) are pleased to present this course on cross-border mediation that deals with the rapidly growing area of private international mediation, and offers participants a framework for understanding cross-border mediation practice and the opportunity to develop specialized mediation skills relevant to cross-border settings.  Participants will also be asked to simulate role-play exercises to develop skills as a mediator.

The course will focus on skills and knowledge relevant to cross-border mediations involving:

  • international and intercultural competencies;
  • online and face-to-face mediation processes and protocols; and
  • knowledge of the applicable law in relation to the substantive and procedural aspects of mediation.

Upon successful completion of the course, participants may be able to apply to become a Singapore International Mediation Institute (SIMI) mediator.

This course is led by world-renowned faculty and award-winning author, Prof Nadja Alexander, with the support of her team from SIDRA.  The course materials are jointly developed with the Singapore International Mediation Centre (SIMC), which specialises in the resolution of cross-border commercial disputes.  SIDRA is a SIMI partner that is able to assess and submit participants’ names to become SIMI Level 1 mediators.  SIMC is a SIMI partner that is able to assess and submit participants’ names to become SIMI mediators, up to the highest tier of the SIMI Credentialing Scheme.

ASSESSMENT DETAILS

Participants must satisfy all components of the assessment in order to pass and receive SIMI Level 1 accreditation:

(a) Overall Participation

(b) Recorded Roleplay: The recorded roleplay will be assessed according to the SIDRA Mediator Competency Assessment Framework. Participant skills will be evaluated within a value scale from 5 to 1 (5 = exceptional competence demonstrated, 1 = not yet demonstrating competence).

(c) Reflective Practice: The reflective practice component comprises two self-reflective pieces, one of which is to be completed before the roleplay assessment and one after the roleplay assessment. This reflective practice is pass/fail.

Participants who successfully complete the assessment may be eligible for Singapore International Mediation Institute Level 1 Accreditation if they fulfil the requisite criteria. Accreditation or certification at higher levels may take place through the Singapore International Mediation Centre, which is a SIMI Qualifying Assessment Program. Any participant who wishes to receive SIMI Level 1 Accreditation (or higher) upon notification of their passing the course may inform the course administrators at any time within one calendar year following the successful completion of the assessment. That participant’s course assessment will then be referred to an independent assessor for accreditation purposes.

The registration fees for this course is S$3,200* plus GST. This is inclusive of the independent assessor’s fees for accreditation purposes, but does not include any fees payable to SIMI and/or SIMC.
