SYNOPSIS

Rigorous and practical 3-day workshop on international commercial arbitration, consisting of a plenary day lecture and instructor-led discussions on key considerations and practicalities on every stage of the arbitration process. This will be followed by a mock international arbitration workshop consisting of a hands-on, practical exercise that immerses participants in the procedural and substantive realities of international arbitration, building advocacy skills and strategic insight in a controlled, supportive environment.

Participants can choose the session(s) that best fit their schedule and interests.

Day 1 (July 29): Plenary

The following topics will be covered: 

  • Case analysis: Strategizing claims and defenses
  • Managing multi-jurisdictional and cross-cultural challenges
  • Pre-dispute negotiation and mediation
  • Filing and commencing the case
  • Arbitrator selection and constitution of the Tribunal
  • Agreeing and advocating for procedure in an arbitration
  • Filing principal submissions in the case (Statement of Case, Statement of Defense, Statement of Reply, and Statement of Rejoinder)
  • Witness selection and witness statements and how to respond to them
  • Expert selection and use of expert reports and how to respond to them
  • Written and oral openings
  • Use of demonstratives in international arbitration
  • Openings and cross-examination of witnesses
  • Closings
  • Post hearing briefs
  • Post-award procedures – setting aside and enforcement of awards

Discussion on Technology and AI in Arbitration

Practical demonstrations and discussions on the use of technology and AI in arbitration proceedings. 

Cybersecurity, confidentiality, and remote hearings.

 

Day 2 and 3 (July 31 and Aug 1): Mock International Arbitration Workshop
Unique opportunity for participants to practice advocacy, examining witnesses, and presenting arguments in a simulated arbitral setting.

Day 2: Focus on drafting and presenting opening statements

Day 3: Examination in chief and cross examination of witnesses.

ABOUT THE SPEAKERS

Dan Tan
Dan Tan is principal of Dan Tan Law, a boutique law firm based in Singapore, San Francisco and New York. The firm has been repeatedly ranked amongst the top 100 of all arbitration practices in the world. Dan acts as counsel in arbitrations all over the world, and has also sat as arbitrator in more than 50 international arbitrations. He is admitted to practice in New York, California, District of Columbia, England & Wales, and Singapore and frequently appears in the courts in international litigation cases.

Dan is ranked as a leading arbitration lawyer by Chambers USA and Legal 500 and is ranked in Band 1 for enforcement of arbitration awards and foreign court judgments. Dan is Lecturer on Law at Harvard Law School (teaching international arbitration for the past 17 years) and Lecturer in Law at Stanford Law School (teaching international arbitration and international investment law for the past 8 years). He was previously Lecturer in Law at Oxford University (teaching contract law). He has an associate tenant at 36 Group, a commercial barristers’ set in London.


Mark Beckett
Mark has over thirty years of experience as an arbitration practitioner and was formerly head of the international arbitration at major international law firms in their New York and Paris offices. He has served as counsel in over 150 international arbitrations including commercial and treaty arbitrations.  He has served as a Lecturer on Law for the past 17 years at Harvard Law School teaching international arbitration with Dan and has also taught a course on Dispute Resolution and Technology at the University of Miami Law School.  Mark has also served on the International Court of Arbitration of the International Chamber of Commerce as the US member.  He practices with Dan Tan Law in international arbitrations, international litigation in the U.S. courts, and multi-jurisdictional disputes and investigations.
