SYNOPSIS
Good faith in contractual relationships has traditionally found more of a home in civil law than common law. A number of leading Singapore cases have suggested, however, that it may not be as irrelevant as it was once was under classical English jurisprudence. Even so, the application of good faith in contract law is carefully guarded. These lectures explore to what extent good faith can, if at all, be implied in contracts, aid in the interpretation of contracts or dictate the performance of contractual obligations.
ABOUT THE SPEAKERS
Chan Leng Sun SC
Leng Sun is a Senior Counsel of the Supreme Court of Singapore. He is the Deputy Chairman of the Singapore International Arbitration Centre and the SGX Appeals Committee. He is a member of the ICC Commission on Arbitration and ADR and the Advisory Panel of the Singapore Maritime Foundation.
Leng Sun is qualified in Malaysia, Singapore and England. He frequently acts as lead counsel in a broad range of commercial areas that cover technical disputes, maritime law, international trade, insurance, company law and financial fraud.
Leng Sun is a Chartered Arbitrator, the Immediate Past President of the Singapore Institute of Arbitrators (SIArb) and the former Global Head of Arbitration of an international law firm. He has acted as counsel or sat as arbitrator in arbitrations seated in Asia, Europe and USA under ad hoc and institutional rules. He is a Chairperson of the arbitration panel jointly appointed by the EU and Korea under the protocol on cultural cooperation of the Korea-EU FTA.
Leng Sun is a Singapore delegate to the UNCITRAL Working Group on Arbitration and was a legal officer of the United Nations Compensation Commission in Geneva.
Leng Sun had taught at the law schools of National University of Singapore and the Singapore Management University. He is the author of the book Singapore Law on Arbitral Awards and Co- Editor of Conflict of Laws in Arbitration.
Leng Sun is recognized among the top lawyers worldwide by "Who's Who Thought Leaders – Litigation 2020", "Who's Who Legal - Arbitration 2020". He is rated as a star in Benchmark Litigation Asia-Pacific 2018 and Acritas Stars 2019. He is described by Chambers Asia-Pacific 2017 as "one of the best arbitrators and practitioners in arbitration.” According to Legal 500 Asia Pacific 2019, clients describe him as “efficient and user-friendly”, “a team player” and “a meticulous and persuasive advocate with a wide range of experience within shipping and in more general commercial disputes”.
Goh Yihan
Professor Goh’s research focuses primarily on the law of contract and torts, with a secondary interest in the principles of statutory interpretation and the legal process.
He has published numerous books, chapters and journal articles internationally and in Singapore, which have been cited on multiple occasions by the Singapore courts and the Federal Court of Malaysia. He has been appointed amicus curiae before the Singapore Court of Appeal and the Singapore High Court. In recognition of his invaluable contributions to the development and advancement of Singapore law, he became the youngest recipient of the pentennial Singapore Academy of Law Singapore Law Merit Award in 2013. He obtained his LL.B. (First Class Honours) from the National University of Singapore on a University Undergraduate Scholarship, where he graduated as the top student in 2006. He subsequently obtained a LL.M. from Harvard University in 2010 on a NUS University Overseas Graduate Scholarship.

Seminar fee of S$150* (inclusive of GST) applies.
b. Group Registration Seminar fee of S$135* (inclusive of GST) applies if there are at least 10 participants from the same organisation.
c. SMU Alumni (for LLB / JD / LLM graduates) Seminar fee of S$135* (inclusive of GST) applies for SMU LLB / JD / LLM Alumni.
*Please note that there will be no refund of any fees should the participant cancel the registration/ fail to attend the seminar. However, registration is transferable. Notice of any change in participant should be sent to the Academy via email: smulawacademy@smu.edu.sg, by 7 August 2020.
