As we emerge from the Covid 19 pandemic into a post Covid era, we are seeing a growth in construction projects driven by the backlog of projects affected by the pandemic. With demand in the industry expected to return to pre-pandemic levels, disruptions to construction projects are likely to remain with continuing Covid-19 uncertainties in some regions and the geopolitical climate causing a number of issues in relation to supply chain and logistics. Companies are responding to the need to implement strategies that can deal with potential disruptions to projects and manage these uncertainties efficiently and effectively.
Escalation in the number of disputes between parties to the construction projects is also expected. The disputes typically relate to canceled or delayed projects, delays with delivery of building materials, extensions of time, liquidated damages and variation claims. There is much to be learnt from recent construction disputes over the past two years, which illuminate the issues that are most prevailing in this climate.
This session will analyse a number of recent construction cases that have arisen in Singapore, the UK, Australia and Malaysia - in relation to various issues such as performance bonds, liquidated damages, no oral modification clauses and completion of works.

Nandakumar (Kumar) Ponniya heads the Dispute Resolution Practice of Baker & McKenzie in the Asia-Pacific.
He is widely acclaimed in international arbitration and cross-border litigation, with particular expertise in the areas of construction, technology and energy. His practice includes dealing with disputes arising from corporate and commercial matters, and managing multi-jurisdictional restructuring and insolvency. With over 20 years’ experience, Kumar has handled disputes and matters across various industry sectors and jurisdictions, serving clients in Asia and beyond.
He is qualified to practice in Singapore, England & Wales and New York; and is also a Fellow of the Chartered Institute of Arbitrators.
Ng Kim Beng
Kim Beng has more than two decades’ experience specialising in International Arbitration practice and in Construction & Projects.
He is recognised as a leading individual for International Arbitration in The Legal 500 Asia Pacific and Best Lawyers. IFLR 1000 has commended him for his work in Project Development and in Energy and Infrastructure disputes. He is also recognised by Chambers Asia Pacific and Asialaw Profiles 2022 for his work in construction and infrastructure disputes.
Kim Beng is a Senior Accredited Specialist in Building and Construction Law, and he currently chairs the Building & Construction Law Committee of the Law Society of Singapore.
