This Masterclass explores the practical issues commonly encountered by legal practitioners and loss quantification expert witnesses relating to valuation and the quantification of economic damages in the context of commercial disputes.
The Masterclass will provide attendees with an overview of damages theory and a fundamental understanding of different types of approaches commonly adopted to quantifying damages and valuing businesses. The Masterclass will also consider the economic consequences of COVID-19 and its implications for damages assessments in times of heightened uncertainty.
These issues will be examined from a practical perspective with the benefit of expert insights from leading loss quantification expert witnesses. Topics will be illustrated with examples from recent damages awards along with hands on case studies and discussion. This two-part Masterclass will cover the following topics:

- Common issues and considerations in damages assessment, such as: the date of assessment; the use of hindsight; and mitigation

SPEAKERS
James Nicholson
James Nicholson is a Senior Managing Director at FTI Consulting and leads FTI Consulting’s Economic and Financing Consulting business in Asia. He has 25+ years’ experience as a consultant on matters of finance, strategy, and economics. Since 2005, his work has primarily involved issues of the identification and valuation of lost profits, and the valuation of businesses, financial assets including shareholdings, and other assets, and of wasted costs.
He has testified 45 times before commercial and investment treaty arbitration tribunals, the Singapore High Court, and the Singapore International Commercial Court. James is a member of the Executive Committee of the Foundation for International Arbitration Advocacy (FIAA), from 2014 to 2021 was President of the Standing Committee of the ICC’s International Centre for ADR, and has been cited on a point of valuation by the Swiss Federal Supreme Court. Since 2015, James has been identified by Who’s Who Legal as one of the five-ten ‘Most Highly Regarded Individuals’ and ‘Global Elite Thought Leaders’ in Europe in its listings of the leading expert witnesses active in international arbitration.
Oliver Watts
Oliver Watts is a Managing Director at FTI Consulting and is based in Singapore. He performs economic and financial analysis and business valuations in a variety of contexts including post-acquisition disputes, shareholder disputes, patent infringement, and contractual breaches.
He has significant experience in valuation and lost profits analysis and has been appointed or testified as an expert witness on matters before SIAC, the Singapore High Court, and the Hong Kong High Court. He has been identified as a Future Leader in Who’s Who Legal’s 2022 list of arbitration expert witnesses.
