SYNOPSIS
Where a defendant asks another to perform a task for him, is he liable if the latter causes tortious harm to the plaintiff? There is no straightforward answer to this apparently simple question.
One basis of liability is non-delegable duty, an area of law recently elaborated upon by the UKSC in Woodland v STA [2013] 3 WLR 1227 and the SGCA in MCST 3322 v Tiong Aik [2016] SGCA 40 and Ng Huat Seng v Munib Mohammad [2017] SGCA 58. Another basis, purportedly distinct, is vicarious liability, an area which saw significant expansion through a succession of cases – the Christian Brothers case [2012] 3 WLR 1319, Cox v Ministry of Justice [2016] 2 WLR 806 and, most recently, Armes v Nottingham CC [2017] UKSC 60. A third basis, seldom resorted to, is agency, which was applied in the recent decisions of Ong Han Ling v AIA [2017] SGHC 327, Rohini v Yeow [2017] SGHC 149, Winter v Hockley Mint [2018] EWCA 2480 and Bellman v Northampton Recruitment [2018] EWCA Civ 2214.
For those interested in this perplexing area of law, it is a real challenge to understand the respective bases, appreciate their differences and similarities, and to perceive their future paths. One possibility is that they will converge. This seminar assists participants in understanding the developments and complexities in this area of law.
ABOUT THE SPEAKER
Low Kee Yang is an Associate Professor with the School of Law, Singapore Management University. An author and editor of several law books, including The Law of Guarantees in Singapore & Malaysia, Read the Fine Print: Avoiding Major Legal Pitfalls and Halsbury's Laws of Singapore, Vol 6 - Company Law (2006 Reissue), Dr Low teaches Tort Law and Business Law to undergraduates. His postgraduate teaching includes the teaching of Financial Advisers Law to students in the MSc in Wealth Management programme and Legal Knowledge & Strategy to PhD in Business students.

Group discount fee of S$180* (inclusive of GST) applies if there are at least 10 participants from the same organisation.
c. SMU Alumni fee (for LLB / JD / LLM graduates)
Seminar fee of S$180* (inclusive of GST) applies for SMU LLB / JD / LLM Alumni.
