Competition Law – A Rapidly Developing Area

SYNOPSIS


The Competition Act of Singapore has been in force for more than a decade and the Competition Commission of Singapore has undertaken a number of investigations that have filled out the contours of the law.  The Commission recently took over various consumer welfare responsibilities from a different agency.  How active the Commission will be in consumer protection activities is an open question, but the added responsibilities may affect the breadth and scope of the “whole economy” approach to competition analysis used by the Commission to date. 

 


About 120 nations around the world have competition laws and this number includes most of the major trading partners of Singapore.  Non-compliance can lead to severe penalties, even to criminal liability in some jurisdictions, and any Singapore company that operates across borders should be aware of the basic requirements of competition laws.  The core areas of regulation are much the same everywhere.  Of course, the law applies domestically as well, and a number of local companies or organizations have been investigated and sanctioned for violations locally.

 


This seminar will provide a brief summary of the most important sections of the law plus a discussion of the relevant recent decisions, such as the cartel collusion cases that involved ball bearing manufacturers and electrical capacitor manufacturers as well as the bid rigging investigation of suppliers to the FI event.

 


The second half of the seminar will focus on two areas: (i) the informal consultation procedures of the Commission and how they affect clients in merger or acquisition negotiations, or clients in various joint ventures (such as airline alliances), or clients who enjoy a dominant position within a certain market, or clients who may be considering a leniency application for cartel collusion; and (ii) developments in neighbouring jurisdictions where Singapore companies are active with special attention to the issue of vertical restraints, such as retail price maintenance schemes, which are not prohibited by Singapore law but which may be prohibited by laws elsewhere, as e.g., in Malaysia, Indonesia, many parts of the EU, etc.


 

ABOUT THE SPEAKER


Professor Howard Hunter came to Singapore in 2004 as President of Singapore Management University and Professor of Law.  He completed his service as President in 2010 but has continued as Professor of Law since then.  He has served on numerous boards and committees in Singapore and was, for one three year term, a member of the Competition Appeal Board.  For six years he has been teaching the Competition Law course at SMU and has contributed to the CCS Blog and to various conferences on the subject.  Prior to his arrival in Singapore, Professor Hunter was a member of the Emory University Law Faculty (Atlanta) for 28 years, and served for 12 years as Dean of the Law School and for two years as Interim Provost of the University.  He has had extensive experience in antitrust law, both in private practice and as a consultant after becoming a legal academic.  He earned his undergraduate and law degrees from Yale University.

Seminar fee of S$150* (inclusive of GST) applies.

 


b. Group discount fee

Group discount fee of S$135* (inclusive of GST) applies if there are at least 10 participants from the same organisation.

 


c. SMU Alumni fee (for LLB / JD / LLM graduates)

Seminar fee of S$135* (inclusive of GST) applies for SMU LLB / JD / LLM Alumni.


 

*Please note that there will be no refund of any fees paid should the participant cancel the registration/ fail to attend the seminar. However, registration is transferable. Notice of any change in participant should be sent to the Academy via email: smulawacademy@smu.edu.sg, by 27 April 2018.


 

SMU School of Law reserves the right to cancel or postpone any event. In such case, we will arrange for the refund of seminar fees paid.
