Business Valuation Disputes in Singapore

SYNOPSIS
The measure of loss in many claims under contract and tort is often presented as a business valuation. With this discipline commonly being referred to as an art as much as a science it comes as no surprise that parties and their experts often have wildly differing views of the value lost and how it should be calculated.
The first half of this seminar will give attendees a broad understanding of business valuation terminology, principles, methods and practice through a worked case study. It will also touch on the professional and technical environment within which business valuation professionals operate as well as the form and content of their work product.
Drawing on a combination of the speaker’s own experience before courts and tribunals together with judgments of the Singapore and foreign courts and international tribunals in this area, the second half of the seminar will cover:
- the causes of disputes over business valuations;
- how they have been dealt with by the courts; and
- alternative outcomes that could have been achieved.
ABOUT THE SPEAKER
Iain Potter specialises in litigation support and expert witness assignments, in particular those involving business valuations or complex loss of profits claims and has advised clients, given evidence and testified before courts and arbitral tribunals in a number of jurisdictions including the UK, Singapore, Malaysia and Thailand.
In addition to being a qualified Chartered Accountant in both England (ICAEW) and Singapore (ISCA), Iain is a Fellow of the Chartered Institute for Securities and Investments and holds their Diploma as well as the ICAEW's Corporate Finance Diploma. He is a member of the American Society of Appraisers and the National Association of Certified Valuators and Analysts, two of the leading business valuation professional bodies, and has passed both bodies' business valuation accreditation exams.
Iain holds undergraduate degrees in Mathematics and Law, a Master's degree in Law from the University of London and is a current PhD student with the University of Leicester where his research focuses on adjustments for the time value of money and risk in awards of damages
FEES
a. Seminar fee
Seminar fee of S$200* (inclusive of GST) applies.
b. Group discount fee
Group discount fee of S$180* (inclusive of GST) applies if there are at least 10 participants from the same organisation.
c. SMU Alumni fee (for LLB / JD / LLM graduates)
Seminar fee of S$180* (inclusive of GST) applies for SMU LLB / JD / LLM Alumni.
*Please note that there will be no refund of any fees paid should the participant cancel the registration/ fail to attend the seminar. However, registration is transferable. Notice of any change in participant should be sent to the Academy via email: smulawacademy@smu.edu.sg, by 18 May 2018.
SMU School of Law reserves the right to cancel or postpone any event. In such case, we will arrange for the refund of seminar fees paid.
