SYNOPSIS
In this lecture, Prashant Reddy will discuss the historical context of two important Indian judgments in the field of patent law and copyright law, on the basis of his recently published scholarship: Create, Copy, Disrupt: India’s Intellectual Property Dilemmas.
The first issue, will be the debate on the grant of pharmaceutical patents and access to medicines in India, starting from 1970 and ending with the judgment of the Indian Supreme Court in the Glivec case, in 2013. The provision at dispute in this case was Section 3(d) of the Patents Act which introduced “efficacy” into Indian patent law.
The second issue pertains to copyright in educational material and access to knowledge. In the sixties, India led a movement to reform the Berne Convention to meet the challenges faced by developing countries. More recently, the debate on access to knowledge has been reignited by the judgment of the Delhi High Court in a lawsuit filed by international publishers against Delhi University and a photocopy shop operating on its premises.
Professor Liu will introduce the speaker and act as a moderator for the debate questions following the lecture.
SPEAKER

Prashant Reddy T. is a Research Associate at the Applied Research Centre for Intellectual Property Assets in Asia (ARCIALA). He has formerly worked in Indian law firms and an Indian university. His scholarship focuses on various aspects of Indian IP law. His most recent book Create, Copy, Disrupt: India’s Intellectual Property Dilemma’s (co-authored with Sumathi Chandrashekharan) was published by Oxford University Press earlier this year. With effect from 1 September 2017, Prashant will be appointed as Assistant Professor, National Academy for Legal Studies and Research (NALSAR).

Professor Kung-Chung LIU holds LLB and LLM degree from National Taiwan University and a Doctor of Law degree from the Ludwig Maximilian Universitaet (University of Munich). He was a Research Fellow at Academia Sinica, Taiwan between 1992/1-2017/1. In 2003, he was a Visiting Professor at the Faculty of Law of the National University of Singapore and Visiting Senior Research Fellow for the IP Academy of Singapore. Professor Liu has served as one of the founding Commissioners of the National Communications Commission in Taiwan between 2006 and 2007. In 2014/4-15/7, he was a Visiting Professor at the School of Law, Singapore Management University, and the Founding Director of the Applied Research Centre for Intellectual Assets and the Law in Asia (ARCIALA). He is currently the Director of ARCIALA, Lee Kong Chian Professor of Law (Practice). In addition, Professor Liu has been co-appointed Professor of the Renmin University of China (2017), and of the Graduate Institute of Technology, Innovation & Intellectual Property Management, National Chengchi University, Taiwan (since 2010).
