Arbitration and Winding Up: Is it Time to Embrace Change?


The lecture explores the complex interplay between arbitration and insolvency, focussing on how insolvency proceedings affect arbitration agreements and vice versa. In particular, the lecture will consider the impact of insolvency proceedings on arbitral agreements and ongoing arbitrations, the effect of arbitration on the administration of insolvency estates, and the evolving debate over whether disputes such as avoidance actions, creditor claims, and restructuring arrangements should be deemed arbitrable. Through an examination of jurisprudence, policy analysis and practical insights, the lecture aims to unravel the key points of friction between arbitration and insolvency, evaluate current approaches, and propose ways to achieve greater coherence in resolving disputes at this intersection.

The Right Hon Lady Arden
International Judge of the Supreme Court of Singapore
Former Justice of the Supreme Court of the United Kingdom

Lady Arden serves as an International Judge on the Supreme Court of Singapore.

She was a Justice of the Supreme Court of the United Kingdom from October 2018 to January 2022. From 2000 to 2018 she was a judge of the Court of Appeal of England and Wales. Lady Arden was also the Head of International Judicial Relations for England and Wales, responsible for liaison with leading courts across the world. She chaired the Judges' Council Working Party on Constitutional Reform. 

Lady Arden is also a Member of the Permanent Court of Arbitration in The Hague and an ad hoc judge of the European Court of Human Rights in Strasbourg. She has held a number of other public appointments, including Chair of the Law Commission of England and Wales, and member of the Steering Group of the Company Law Review established by the Department of Trade and Industry. Lady Arden has written and lectured on a wide range of legal subjects. She was called to the Bar in 1971 (QC 1986) and appointed a High Court judge in 1993, the first woman judge to be assigned to the Chancery Division. In 2000, she became the third female judge to have been appointed to the Court of Appeal.
