Synopsis
The long-awaited amendments to Singapore’s debt restructuring regime finally came into effect on 23 May 2017. But as the keenest observers would note, this has been accompanied by a flurry of developments in the common law, especially in the area of cross-border restructuring and insolvency. As we begin to settle into this new paradigm, we begin to ask the real questions: What exactly was decided in these new cases? How do the new laws affect transactions, e.g. securitisation, shipping, and lending? What should I worry, and not worry, about?
This seminar focuses particularly on the new developments in Singapore’s insolvency landscape, both at common law and under the Companies Act. This seminar also considers their practical implications, e.g. how the developments impact restructuring efforts, how certain clauses such as that relating to events of default should be amended, which exceptions parties can take comfort in, how many forms a moratorium can take, and what happens when a Singapore court recognises a foreign insolvency.
This seminar is for every practitioner whose work may involve corporate insolvency (whether contentious or non-contentious) or debt financing.
