Synopsis
This seminar seeks to provide an introduction to the legal problems arising out of construction contracts. Many construction contracts are of high value and involve many parties: the customer (employer, principal); a (main) contractor; sub-contractors; suppliers and a range of professional advisers (architects, engineers, quantity surveyors). The interests of these parties often diverge and disputes are common.
The seminar will cover the following topics:
- The cast of those involved in construction contracts;
- Types of contract;
- The position of the architect / engineer/ superintendent;
- Duties of the contractor;
- Duties of the employer;
- Certificates;
- Damages for defective work;
- Variations;
- Claims for extra money;
- Claims for extra time;
- Liquidated damages;
- Sub-contractors
The seminar will be useful as a refresher of the basics for lawyers and in-house counsel in this area and for lawyers who are new to the area of construction contracts. No particular prior knowledge is required.
About the Speaker
Michael Furmston studied law at the University of Oxford and taught at the University of Birmingham, Queen’s University, Belfast and University of Oxford before moving to Bristol in 1978. He was appointed as Dean of the Faculty of Law at the University of Bristol for two terms and also served as Pro Vice-Chancellor from 1986 to 1989 before retiring in 1998. Michael was appointed Emeritus Professor and Senior Research Fellow at Bristol and is a member of the UNIDROIT (International Institute for the Unification of Private Law) working group which has produced a set of General Principles for International Commercial Contracts. He sits on the editorial boards of the Journal of Contract Law and Construction Law Journal, amongst others.
Michael was called to the Bar at Gray’s Inn in 1960 and has been a Bencher of Gray’s Inn since 1989. He was counsel in the leading House of Lords decision on contractual damages in Ruxley v Forsyth. Michael has been the editor for the last 30 years of Cheshire, Fifoot & Furmston on Contract (currently into its 16th edition) and the joint author of Beale, Bishop & Furmston: Cases and Materials on Contract. He has also written books and articles in the fields of Sale of Goods and Construction Law and is the editor of the Construction Law Reports.
Michael was the Dean of SMU School of Law from 2007 till 30 June 2012. He was named as one of the “Ten Great Law Teachers” in UK by the London Times in October 2007 and has recently completed books on Contract Formation and Privity of Contract. He was also awarded the Honorary Degree of Doctor by the Open University.

d. Student rate Seminar fee of S$50* (inclusive of GST) applies for full-time undergraduate student (matriculation card must be provided in order to enjoy this entitlement).
