To Challenge or Not, and When: Complications and Issues in Dealing with Objections to an Arbitral Tribunal's Jurisdiction

SYNOPSIS
This talk traverses the developments in Singapore law on the recourses available to parties who object to an arbitral tribunal's jurisdiction, and the arbitral tribunal's determination of their jurisdiction, particularly as a preliminary question under Article 16(3) of the UNCITRAL Model Law. Structured as a panel discussion with the intention of facilitating dynamic audience participation, the panellists will share and exchange views on the state of the law in this regard, with particular emphasis on the construction of Article 16 of the Model Law and section 10 of the International Arbitration Act, as well as the High Court and Court of Appeal decisions in PT First Media v Astro Nusantara International, and the High Court's decision in Rakna Arakshaka v Avant Garde Maritime Services.

Seminar fee of S$135* (inclusive of GST) applies for SMU LLB / JD / LLM Alumni.
*Please note that there will be no refund of any fees paid should the participant cancel the registration/ fail to attend the seminar. However, registration is transferable. Notice of any change in participant should be sent to the Academy via email: smulawacademy@smu.edu.sg, by 11 January 2019.
SMU School of Law reserves the right to cancel or postpone any event. In such case, we will arrange for the refund of seminar fees paid.
