Lee Baker
Managing Director
FTI Consulting
Chris Rudland
Director
FTI Consulting

SYNOPSIS

This F2F Executive Masterclass is intended to provide attendees with an understanding of the principles involved in expert evidence relating to both delay and quantum in construction disputes. These principles will be explored mainly in the context of arbitration, including the key considerations and practicalities arising from the tribunal’s directions and procedural orders.

The Executive Masterclass will include interactive elements to allow participants to consider how the principles of delay and quantum can be applied to real-life situations. Participants will be encouraged to consider the wider legal implications of these case studies, and how this may shape their approach to how delay and quantum expert evidence fits into a construction dispute.

The Executive Masterclass will cover the following topics:

Delay

  • Extension of Time principles and mechanism;
  • Approach to delay analysis;
  • Prospective vs retrospective;
  • Causation of delay events; and
  • The Delay Expert Report

Quantum

  • Categorising costs;
  • Proof of cost;
  • Records;
  • Contractual claims;
  • Damages claims; and
  • The Quantum Expert Report.
