UNRAVELLING THE WORLD OF DATA, GENERATIVE AI AND PRIVATE LAW
Repeated scandals and the rapid development of technology and business models reliant on intensive data processing have thrust data protection and privacy issues to the fore. The regulation of data (mis)use is of paramount importance in mitigating the risks of harm to individuals, consumers and communities linked to the emergence of the digital economy.
In recent years, law and policy debates have largely focused on how data protection/privacy legislation can and should be adopted or updated to respond.
Far less has been written about the application of private law doctrines (e.g. tort and contract) to transactions and interactions concerning data, and demands for data and consumer protection.
Building on the launch of a new book Data and Private Law (Hart Publishing, 2023), our expert speakers will discuss two areas of practical and theoretical importance: (a) the treatment of data and legal duties in the new Generative AI era; and (b) the various measures that private litigants in different jurisdictions can take to enforce data rights.
The thematic panel discussions will illustrate the role of, and potential for, private law in responding to the potential benefits and risks of harm arising from the collection and use of data.
