The course is divided into two modules. Interested participants may choose to enrol in both modules or in one module. A certificate of attendance will be provided for each module.
Module 1: Introduction to US Corporate Restructuring Law and Practice (9hrs)
This module introduces the theoretical and doctrinal foundations of corporate bankruptcy law and practice in the United States. The course will explore the core provisions of United States Bankruptcy Code, the purpose behind those provisions, and their practical applications. The module will also introduce general legal principles related to the governance and reorganization of insolvent and financially distressed business firms and special characteristics of United States bankruptcy law. The materials will also cover major cases, recent developments, and the common practices of bankruptcy lawyers in the United States.
Module 2: Collapse of Crypto Exchanges and Other Recent Trends in Corporate Restructuring (9 hours)
This module will examine the collapse of firms in crypto asset markets and the related bankruptcy cases. Starting with the collapse of TerraUSD in 2022, the crypto market saw a string of crypto firms enter bankruptcy including Three Arrows Capital, Voyager, Celsius, FTX, BlockFi, Core Scientific, and Genesis. These cases have presented unique challenges for bankruptcy courts and practitioners. This module will explore how these challenges are playing out. The topics covered will include valuation, classification of property rights in crypto assets, preference litigation, treatment of executory contracts, and asset tracing. The module will also look at differences in how similar cases have played out in other jurisdictions including Singapore.

SPEAKER
Tony Casey is Donald M. Ephraim Professor of Law and Economics at The University of Chicago Law School. He is also the Faculty Director of the Law School’s Center on Law and Finance. His research examines the intersection of finance and law, with a focus on corporate bankruptcy. He has written about topics including asset valuation, creditor priority, the constitutionality of bankruptcy courts, and intercreditor agreements.
Before entering academia, Professor Casey practised as a partner with Kirkland & Ellis LLP. His practice focused on corporate bankruptcy, merger litigation, and securities litigation. Professor Casey received his JD, with High Honors in 2002 from The University of Chicago Law School.
In September 2023, he will be visiting Singapore Management University as SGRI Visiting Professor.
