SYNOPSIS
Recent events in the cryptoindustry, such as the decline of Bitcoin, the collapse of various cryptoexchanges and stablecoins, Coinbase’s disclosure to the SEC clarifying the treatment of their users in the event of insolvency, and the suspension of withdrawals, trading and deposit by Singapore-based crypto CeFi lender Vauld have accentuated the attention of the legal and financial community on the treatment of cryptocurrencies and cryptoexchanges in insolvency. Led by two prominent experts who have been involved in some of the most relevant cases involving cryptocurrencies and insolvency, this webinar will provide a unique case study approach for the understanding of the practical challenges that lawyers, insolvency practitioners, judges, regulators and financial advisors face when dealing with insolvency, cryptocurrencies, and service providers in these markets. Namely, the webinar will discuss, among other aspects:
Legal nature of cryptocurrencies and the state of the debate in Singapore and internationally
Valuation of claims associated with tokens and cryptocurrencies in insolvency
Eligibility of cryptoexchanges for the initiation of ordinary insolvency proceedings
Treatment of crypto users and tokenholders in the event of insolvency
Safekeeping and management of cryptoassets in insolvency proceedings
Investigations and recovery of cryptoassets in insolvency proceedings

Nydia Remolina
Nydia Remolina is Assistant Professor of Law at Singapore Management University where she leads the research group on FinTech at the Centre for AI and Data Governance. Nydia focuses her research on the intersection of law, finance and technology. Nydia has more than 10 years of experience in the financial sector and has been a Senior Advisor to the OECD and she worked at Sullivan & Cromwell’s New York Office. Nydia has a Master in the Science of Law (JSM) from Stanford University, and is completing her PhD in Law at the University of Zurich. Nydia’s research has been published in internationally recognised peer review journals, cited in media outlets such as Forbes, and featured on the Harvard Law School Forum on Corporate Governance, the Columbia Law School Blue Sky Blog, the Oxford Business Law Blog, and the Machine Lawyering Blog of the Chinese University of Hong-Kong.

Rose Kehoe
Rose Kehoe is an experienced finance professional with expertise in restructuring over wide‐ranging situations, environments and industry sectors. She brings strategic insight through experience in restructuring advisory across Asia and with global reach. She is known for her ability to identify key issues in complex and time sensitive situations, and in leading and facilitating discussions and negotiations on behalf of her clients towards managed outcomes supported by facts driven analysis. Rose is a well-known expert in the cryptocurrency space, having led the case management of Torque Trading and as the independent financial advisor in the Vauld Group restructuring; and is regularly invited to speak on this topic.
Danny Ong
Danny specialises in complex international commercial and financial disputes and investigations, as well as cross border restructuring and insolvency, across a multitude of industries. Notably in the blockchain and cryptocurrency space, he successfully prosecuted the first cryptocurrency claim before the Singapore International Commercial Court and Singapore Court of Appeal, which raised novel and complex legal issues as to the nature and trading of cryptocurrencies, and the application of principles of contract law to algorithmic trading programmes. Danny is also regularly called upon to investigate into and prosecute cross-border crypto fraud and asset recovery cases, and advise on the insolvencies of distressed cryptocurrency businesses. His interest in this area has also seen him lecture on blockchain disputes at the Singapore Management University.
