SYNOPSISMicro and small enterprises (MSEs) represent the vast majority of businesses in most countries around the world. Despite their economic relevance, most jurisdictions do not provide a suitable insolvency framework for MSEs. In the past few years, however, several jurisdictions have adopted simplified insolvency proceedings for MSEs. This event seeks to analyze the features and performance of the simplified insolvency frameworks adopted in Australia, Singapore and the United States. Based on the experience of these jurisdictions, the event will also discuss how countries can improve the attractiveness of their insolvency frameworks for MSEs. Professor Edith Hotchkiss is a professor in the Seidner Department of Finance at the Boston College Carroll School of Management. Her research focuses mainly on corporate finance, more specifically, the efficiency of Chapter 11 bankruptcy procedures; restructuring mechanisms for financially distressed firms; transparency and efficiency of the corporate bond market. Professor Hotchkiss has worked for New York University as a Visiting Assistant Professor of Finance and at Standard & Poor's Corporation as an Assistant Vice President. She is a member of the academic advisory board and has served on the board of directors of the Turnaround Management Association. Jason Harris is Professor of Corporate Law at the University of Sydney Law School. Professor Harris teaches and researches in the areas of Corporate Law, Insolvency Law, Commercial Law and Contracts. His research is focused on the public and private regulation of financially distressed companies, including debt restructuring, voluntary administration, corporate governance and directors’ duties during financial distress and the regulation of corporate groups. She is the Head of the firm’s Restructuring & Insolvency Practice and a Partner in the International Arbitration, India and Special Situations Advisory Practices. Her main areas of practice are corporate disputes and restructuring.
