SYNOPSIS


The seminar will provide an update on recent case law, looking at important decisions by the Court of Appeal in England on the scope of litigation privilege and legal advice privilege and comparing them with the approaches taken by the Singaporean Courts.


Particular topics considered include the meaning of reasonably anticipated litigation, the application of the dominant purpose test to corporate internal investigations, the effect of plea bargaining processes with regulators on the status of privileged material, joint and common interest privilege, the procedure for determining privilege claims and remedies in respect of privileged material that has escaped the privilege holder’s confidential sphere.

ABOUT THE SPEAKER


Andrew Higgins is an Associate Professor of Civil Procedure at the University of Oxford and a fellow of Mansfield College. He is currently the General Editor of Civil Justice Quarterly and the academic member of the Civil Justice Council, a government body responsible for overseeing and co-ordinating the modernisation of the civil justice system. 



Andrew previously worked as a solicitor for the Australian law firm Slater & Gordon, and was admitted to the Victorian Bar in 2011.  Andrew has published on a wide range of civil procedure related subjects including a book on legal professional privilege (A Higgins, Legal Professional Privilege for Corporations OUP 2014).   

 


 


FEES


a. Seminar fee

Seminar fee of S$150* (inclusive of GST) applies.

 


b. Group discount fee

Group discount fee of S$135* (inclusive of GST) applies if there are at least 10 participants from the same organisation.

 


c. SMU Alumni fee (for LLB / JD / LLM graduates)

Seminar fee of S$135* (inclusive of GST) applies for SMU LLB / JD / LLM Alumni.


 

*Please note that there will be no refund of any fees should the participant cancel the registration/ fail to attend the seminar. However, registration is transferable. Notice of any change in participant should be sent to the Academy via email: smulawacademy@smu.edu.sg, by 8 March.


 

SMU School of Law reserves the right to cancel or postpone any event. In such case, we will arrange for the refund of seminar fees paid.
