SYNOPSIS
The role of online intermediaries in today’s marketplace is ever expanding, given the vast array of services that are available online today. Consider how you are now able to buy clothes and shoes conveniently using an online platform, from the comfort of your own home. Technology has evolved so rapidly such that algorithms are largely responsible for each transaction that you make on these online platforms. Given the popularity of this business model today, piracy inevitably creeps in to take advantage of the convenience and the widespread reach of online platforms. However, if most of the functions of the online platforms are automated, who should be responsible for policing them? Should it be left up to legislation, or should online intermediaries police themselves? What can content owners do to assist in this process?

SPEAKERS, PANELLISTS AND MODERATORS

ANG Kai Hsiang is responsible for legal and regulatory matters for eBay in Southeast Asia and Israel. Prior to joining eBay, Kai Hsiang practiced in the Singapore office of Baker & McKenzie and represented clients in a number of commercial disputes, including employment-related matters. He began his legal career in the intellectual property department of Bird & Bird ATMD, where he was involved in several landmark intellectual property disputes before the Singapore High Court and Court of Appeal (including acting for Amanresorts Limited in the enforcement of its well-known trade mark, and acting for RecordTV Pte Ltd in a claim against Singapore’s national broadcaster for groundless threats of legal proceedings). Kai Hsiang is a qualified advocate and solicitor of Singapore and is also qualified in England & Wales.

ANG Kwee Tiang (KT Ang) is the IFPI Regional Director for Asia Pacific. IFPI represents the recorded music industry worldwide with more than 1,300 record producers and distributors from over 66 countries. Mr Ang coordinates IFPI's priorities across the region, leading legal policy and government affairs as well as developing the legal and economic framework for copyright that is essential for the further development of the digital music business. Mr. Ang heads the IFPI Asian Regional Office which is in Hong Kong, and the Representative Office in Beijing. He also supervises the IFPI national groups and collecting societies across the region and is engaged in an active program to put in place the legal rights and effective collecting societies for IFPI member companies throughout the region.

Irene CALBOLI is Lee Kong Chian Fellow, Visiting Professor, and the Deputy Director of the Applied Research Centre for Intellectual Assets and the Law in Asia (ARCIALA), School of Law, Singapore Management University. She is also a Professor of Law at Texas A & M University School of Law. Irene started her academic career at the University of Bologna and has held visiting positions at the King’s College London, the University of California Berkeley, the University Complutense, and the Max-Planck-Institute for Innovation and Competition. Irene is inter alia, an elected member of the American Law Institute, an associate member of the Singapore Academy of Law, a member of the Executive Committee of the Intellectual Property Section of the Association of American Law Schools, and a member of the Legislation and Regulation Committee of the International Trademark Association.

Gladys CHUN is the General Counsel of Lazada Group, a subsidiary of Alibaba Group. As the GC, Gladys leads the Legal and Compliance department for Lazada Group and is responsible for all legal and compliance matters across all countries where Lazada has a local presence including Indonesia, Malaysia, Philippines, Thailand, Singapore, Vietnam, Hong Kong and Russia. She supports the management by providing strategic guidance in commercial strategies and risk management across 3 business units including Lazada (B2C platform), helloPay (payments system) and LEX (logistics business). Gladys started her career in corporate/commercial and tax practice before moving in-house into retail, franchising and now, technology. Gladys was awarded the Editor’s In-house Counsel Choice Award by Asialaw during the fifth annual Asia Woman in Business Law Awards organized by Euromoney Legal Media Group in November 2015.

Jane C. GINSBURG is the Morton L. Janklow Professor of Literary and Artistic Property Law at Columbia University School of Law, and Faculty Director of its Kernochan Center for Law, Media and the Arts. She teaches Legal Methods, Copyright Law, International Copyright Law, and Trademarks Law, and is the author or co-author of casebooks in all four subjects, as well as of many articles and book chapters on domestic and international copyright and trademark law. A graduate of the University of Chicago (BA 1976, MA 1977), Professor Ginsburg received a JD in 1980 from Harvard, and, as a Fulbright grantee, a Diplôme d'études approfondies in 1985, and a Doctorate of Law in 1995 from the University of Paris II. She is a Corresponding Fellow of the British Academy, a Member of the American Philosophical Society, a Member of the American Academy of Arts and Sciences, and an Honorary Fellow of Emmanuel College, University of Cambridge.

Trina HA is the Director of the Legal Department at IPOS where she manages the legal affairs of the IP office as well as advising on and reviewing IP legislation and international agreements. She maintains a concurrent appointment as a Faculty of the IP Academy. Prior to joining public service, Trina was in private practice where she specialised in matters involving the protection, management and exploitation of intellectual property rights and in media/entertainment law. She was also at one point legal counsel with the Media Development Authority of Singapore where she drafted, reviewed and negotiated the contracts for the Authority’s range of investments in film, television, animation and game development and production. She has conducted talks and customized workshops on intellectual property rights for various companies, organisations and institutes of higher learning, and was legal adviser to various industry associations. Trina co-authored the volume on Media Law published by Butterworths as the first title in the series of Singapore Precedents and Forms. During her time in legal practice, she was ranked annually since 2007 in the intellectual property industry and TMT industry by the Asia Pacific Legal 500.

Matthew KURLANZIK is the Director of Government Relations, Asia for 21st Century Fox. Based in Hong Kong, he is responsible for supporting public policy and regulatory issues that impact 21 Century Fox’s diverse business units across Asia. Matthew has a particular focus on the digital space and promoting effective policy solutions that encourage innovation and a healthy ecosystem. Previously, Matthew worked on international strategy for an e-commerce company and in various roles across the finance sector. He holds a BS in Marketing and International Business from the University of Maryland and a MA in International Affairs from Columbia University.

Susanna H.S. LEONG is a Professor of Law at the NUS Business School, National University of Singapore. She has published in several international and local academic journals and is the author of the book INTELLECTUAL PROPERTY LAW OF SINGAPORE (2013). Susanna is the Vice-Dean (Graduate Studies) at the NUS Business School. She is also a Senior Fellow at the Intellectual Property Academy of Singapore, a member of the World Intellectual Property Organization (WIPO) Arbitration and Mediation Centre’s Domain Name Panel, a member of The Regional Centre for Arbitration, Kuala Lumpur (RCAKL) Panel, and a member of the Singapore Copyright Tribunal.

Kung-Chung LIU holds a Bachelor of Laws from National Taiwan University and a Doctor of Law degree from the Ludwig Maximilian Universitaet (University of Munich). In 1992, he joined Academia Sinica. In 2003, he was a Visiting Professor at the Faculty of Law of the National University of Singapore and also acted as Visiting Senior Research Fellow for the IP Academy of Singapore. He has served as one of the founding Commissioners of the National Communications Commission in Taiwan. In 2007, he was co-appointed Professor of the Institute of Law for Science and Technology, National Tsing Hua University. In 2010, he was co-appointed Professor of the Graduate Institute of Technology, Innovation & Intellectual Property Management, National Chengchi University. In 2014-15, he was a Visiting Professor at the School of Law, Singapore Management University, and the Founding Director of the Applied Research Centre for Intellectual Assets and the Law in Asia (ARCIALA). He is currently the External Director of ARCIALA.

Althaf MARSOOF is a PhD candidate at the Dickson Poon School of Law, King’s College London and is also attached to the Applied Research Centre for Intellectual Assets and the Law in Asia at the Singapore Management University in a visiting capacity. His PhD research focuses on the approaches of, and challenges in, holding online intermediaries accountable for infringements of trademark rights. Prior to moving onto full-time academic research, he worked for over five years at the Attorney General's Department of Sri Lanka as a State Counsel. Althaf holds a Master of Laws from Cambridge University and a Master of Philosophy from the University of Queensland.

John MEDEIROS is the Chief Policy Officer of CASBAA as well as Senior Government Relations Advisor to the Board. He leads the Association’s program of engagement with governments and the policy community inside and outside Asia. CASBAA’s advocacy of members’ interests and ongoing dialogue with a wide range of regulatory officials on behalf of the pay-TV industry are under his direction. He also coordinates the Association’s research, education, and intellectual property enforcement activities. Since John joined CASBAA, he has spearheaded the Association’s development of a sustained program of regulatory advocacy on behalf of industry growth and development. He is one of the principal authors of the seminal “Regulating for Growth” comparative studies of regulation across the Asian region. Prior to CASBAA, John had a 28-year career in economic diplomacy, with most spent in Asia. Brought up in Massachusetts near Cape Cod, John holds a Master Degree in International Finance and Communications from the Fletcher School of Law & Diplomacy.

Shantini SANMUGANATHAN started her legal career with a three-year stint in private practice handling general commercial work and civil litigation before leaving to join the in-house legal fraternity. Her first in-house legal role was in the real estate and franchising world with ERA before moving on to join the IT industry. She was the solo lawyer charged with the set up and running of the legal affairs of Aztech Systems Ltd and was there for over 5 years, involved with IT contracts (software licensing, distribution), procurement, and set up of factories overseas and supporting the sales operations of the company globally. After that she joined Dell Computer Systems at its Asia Pacific headquarters in Singapore and in her 12 years in Dell, was the legal lead for its various business units including global sales, manufacturing, procurement, marketing, professional services and expansion of its Asia Pacific operations. Shantini joined Singapore Telecommunications Limited in 2011 as the legal head of its Group Enterprise business and is currently the Group General Counsel for the Singtel Group responsible for all the legal affairs of the Group. Shantini graduated from the National University of Singapore with a Bachelors’ in Law degree, and also holds a Masters in Law degree from the University of London. Shantini is a Member of the Singapore International Arbitration Centre Users Counsel, Singapore.

SEE THO Sok Yee joined IPOS after invigorating early years in the IP & Tech department of a top law firm. In the years at IPOS, she has assisted the government in the law and policy of copyright as a member of the IP Inter-Ministerial Committee and as Singapore's representative at the WIPO Standing Committee on Copyright and Related Rights in Geneva. She also helped the then-groundbreaking US-Singapore FTA; and advised IPOS in the area of contract law and risk management. Currently part of the vibrant Hearings and Mediation Group, Sok Yee adjudicates IP disputes and reviews dispute resolution policy and practice, with an interest in access to justice.

Bryan TAN represents major internet and software companies as well as governments and government entities and has led many industry firsts including the first mass e-mail defamation case in the world, Singapore’s first publicized telecoms competition dispute, a pan-Asian co-branded travel portal, the first privately-funded cable landing project in Singapore and the world’s first registrar-level domain name dispute. Since 2004, Mr. Tan is also named one of the leading individuals in IP, IT and telecoms law by Best Lawyers, Chambers, Legal500, Who’s Who and AsiaLaw. He is a partner at international law firm Pinsent Masons. For the last 8 years, Mr Tan has also been a legal advisor to the ASEAN Single Window project and was recently appointed to the UN working party on paperless trade facilitation in the Asia Pacific. Mr. Tan is author of Halsbury's Laws of Singapore - E-Commerce and Halsbury's Laws of Malaysia - E-Commerce (both editions). He also co-wrote the Singapore chapter of Electronic Evidence (three editions) with Prof Daniel Seng, the practitioner’s chapter in Data Protection Law in Singapore and the Singapore chapter on The Comparative Law of Higher Education.

Janahan THIRU is Legal Counsel at ShopBack, an online cashback site that has established itself as the top smart shopping platform in the region. It presently has a presence in Singapore, Malaysia, Indonesia, Philippines, Taiwan and India and its platform includes brands such as Uber, Lazada and Cathay Cineplexes. Having first been involved with ShopBack in the early chapters of its two-year story of rapid growth, Janahan has assisted in managing the company’s legal affairs throughout its various stages of development.

Michael S. ZANEIS was appointed President and CEO of the Trustworthy Accountability Group (TAG) in July 2015, leading TAG’s efforts to eradicate digital advertising fraud, malware, ad-supported piracy, and to increase transparency across the digital advertising supply chain. Prior to taking the helm at TAG, Mike served as the Executive Vice President and General Counsel for the Interactive Advertising Bureau (IAB). As General Counsel for the IAB, Mike oversaw internal legal operations of the organization and provided leadership on key judicial proceedings impacting the interactive advertising industry. Prior to joining IAB, Mike served as Executive Director of Technology and E-Commerce at the U.S. Chamber of Commerce, the world’s largest trade association. As the chief technology and telecommunications lobbyist, he oversaw issues affecting the business community pertaining to online and consumer privacy, data security, telecommunications, intellectual property, counterfeiting, piracy, and e-commerce. He received his bachelor’s degree from Michigan State University and both his Juris Doctor and Masters in Public Policy from Georgetown University. Mike has served as an adjunct professor for Georgetown’s McCourt School of Public Policy.
