Recent Highlights on Commercial Remedies

SYNOPSIS

Remedies are what a commercial litigation client ultimately asks for. What – and when – can the litigator secure for the client?

This seminar will examine the practical aspects of remedies, including interim injunctions that are applied for to secure remedies prior to trial, as well as some novel remedies prayed for as final relief at the end of trial.

Various features and (limitations) of interim remedies like Mareva Injunctions and Proprietary Injunctions, as well as final remedies like Wrotham Park damages will be discussed. By reference to actual litigation cases and real-life scenarios, we will examine the tactical issues and strategic considerations that litigation counsel face in deploying these remedies – including evidential issues, assessment of damages, burden of proof, selection of defendants and impact of insolvency.  

 

This session is part of the SMU Law Academy “Recent Highlights” series. Designed with the busy practitioner in mind, this series provides participants with a convenient platform to obtain timely and practical bite-sized analysis of the latest developments in various areas of the law.
