SYNOPSIS

The importance of urban planning has led commentators such as Forester (2006) to describe planning as an ‘organisation of hope.’ The positive externalities created by good planning are self-evident and have no doubt contributed towards the growth of Singapore as a successful city-state. Tailored for urban planners in Singapore, this 2-day workshop on planning and property law provides participants legal knowledge relevant to their work, and a deeper understanding of the powers statutorily conferred on the Competent Authority and authorised persons. 

Most of the course focuses on planning law where the various parts of the Planning Act 1998, Planning (Master Plan) Rules, and attendant case studies from adjudicated disputes, including the Court of Appeal’s most recent decisions, are examined. This will include an overview of the Master Plan and Conservation Guidelines (Part 2), the procedures for the Master Plan to be amended (Planning (Master Plan) Rules), the Development and the Subdivision of Land, including Appeals to the Minister (Part 3), and the Enforcement provisions (Part 4).. The recently enacted Land Betterment Charge Act 2021 (w.e.f. 1 August 2022), which replaces Development Charge (DC) and the Temporary Development Levy (TDL) under Parts 5 and 5A of the Planning Act 1998 will also be covered, including how planning approval/authorisation triggers the liability to pay Land Betterment Charge as well as concessionary reliefs. Given that the Planning Act 1998 took reference from the Town and Country Planning Act 1990 (UK), comparisons where relevant will be made. Planning cuts across other legislative interests and in this regard, certain sections of the State Lands Act 1920, Residential Property Act 1976 and the Land Titles (Strata) Act 1967 being of relevance to urban planners, will be outlined in the workshop. Through a review of the relevant Hansard comments regarding land use policies and planning in Singapore, government policy regarding planning will also be discussed. 

Planning and property law are in many areas intertwined and the course therefore also covers basic land law principles, tortious liabilities related to land, and incorporeal real interests such as easements. Finally, relevant aspects of administrative law are considered to give participants an understanding of what happens if a planning decision is challenged. 

Overall, the objectives of this 2-day workshop seek to provide participants with a better understanding of relevant legislation, court decisions, and the relationship of policy-making with planning. This is intended to give planners a better understanding of the role of land use planning, development control and conservation within the larger legal framework e.g. how other legislation relates to planning and development control functions and vice versa.

 

SPEAKER

Dr Edward Ti is a multi-qualified professional in the fields of law, real estate and finance. He is admitted to practice law in Singapore, New York, and England & Wales; is concurrently a Chartered Surveyor (MRICS); and holds the Chartered Financial Analyst (CFA) and Chartered Alternative Investments Analyst (CAIA) designations. Dr Ti’s distinctive blend of expertise point toward a deep understanding in all aspects of real property. This includes classical land law, planning law (private and public takings), heritage conservation, strata law and real estate investment trusts (REITs). Dr Ti teaches property law and real estate law to LLB and business undergraduates respectively. At the postgraduate and executive level, Dr Ti has taught real estate law to executives from Mapletree, real estate securitisation to LLM students, and the regulations pertaining to financial advisers to students pursuing the MSc (Wealth Management). Dr Ti has been engaged to share his views with officers across the public service.

After reading law (C J Koh Scholar) and real estate (REDAS Gold Medal) at the National University of Singapore, Dr Ti completed his doctorate at the Department of Land Economy, University of Cambridge, courtesy of a Singapore government scholarship. Dr Ti was concurrently awarded a college prize and a FIABCI Scholarship during his candidature. Concurrent with his academic endeavours, Dr Ti is a consultant with WongPartnership and is a member of the Strata Titles Board.

*SMU Law Academy reserves the right to cancel or postpone any event. In such case, we will arrange for the refund of fees paid. Please note that there will be no refund of any fees should the participant cancel the registration/ fail to attend the event. However, registration is transferable. Notice of any change in participant should be sent to the Academy by 15 January 2025.
