SYNOPSIS

Cybersecurity laws are laws which are aimed at protecting the confidentiality, integrity and availability of computer systems and their data therein. This area of law has been one of the fastest growing areas of law in recent years in many countries. In the United States, the Securities & Exchange Commission passed the landmark Cybersecurity Risk, Management, Strategy Governance, and Incident Disclosure Rules in late 2023 and the European Union’s NIS-2 Directive is set to come into effect in late 2024. In the Asia-Pacific region, many countries have passed cybersecurity laws in many shapes and forms and are planning for additional laws. For one, Singapore plans to revamp its Cybersecurity Act to bring a wider range of entities in scope of its remit and to impose additional obligations.       

The growth in the number of cybersecurity laws, their particularity, teeth, and enforcement are driven by how dependent our societies have become on computers and the internet and the increasing cost of cyberattacks to societies.       

This course will cover: (1) core cybersecurity concepts and principles; (2) legal ramifications of cybersecurity breaches; (3) the three major categories of cybersecurity laws, focusing on the Asia-Pacific region (covering laws from Singapore, India, China, South Korea, Japan, Australia etc). For each topic, multiple real-world examples will be discussed, and the participants will be given several complex case studies inspired by real world events to work together during the course.                 
 

The SMU Law Academy Expert Masterclasses are advanced skills and case-study based programmes where participants will learn from the industry’s top experts in a specific area of practical importance. Typically taught in a face-to-face format, such sessions will help participants to acquire practical in-depth knowhow to aid their development. All the masterclass instructors are specially curated and are recognised as experts in their areas.

 

SPEAKER

Nicholas Seng (LLB, CIPP/A, CIPP/E) is an Associate General Counsel at a Big Five American multi-national technology corporation where he leads its Cybersecurity Law and Investigations team for the Asia-Pacific region. Nicholas graduated Summa Cum Laude (1st Class Hons) from the Singapore Management University and was called to the Singapore Bar. He served as a Deputy Public Prosecutor and State Counsel in Singapore’s Attorney-General’s Chambers, Financial and Technology Crimes Division where he acted as counsel in several landmark criminal law cases before the Singapore High Court and Court of Appeal. Thereafter, he practiced in top-tier American and Singapore law firms specializing in data protection laws, commercial dispute resolution and corporate investigations for Fortune 500 companies in the Asia Pacific region. He is listed as a Singapore Rising Star 2023 by Asian Legal Business, and he is a published author and speaker on cybersecurity laws in the Asia-Pacific region. *Please note that there will be no refund of any fees should the participant cancel the registration/ fail to attend the event. However, registration is transferable. Notice of any change in participant should be sent to the Academy via email: smulawacademy [at] smu.edu.sg, by 22 May 2024.


SMU Law Academy reserves the right to cancel or postpone any event. In such case, we will arrange for the refund of fees paid.
