SYNOPSIS
Letters of credit and demand guarantees (including performance bonds) oil the wheels of international commerce. They remain a steadfast instrument in international trade, and are regarded as good as cash, with few defences to payment. Such limited defences include (depending on the jurisdiction) fraud and unconscionable conduct. In this seminar, the speaker will conduct a comparative analysis of those defences, examining English and Singaporean law, contrasting the position in each country, and providing an update on recent case law.
SPEAKER
Dr Deborah Horowitz is a barrister at Fountain Court Chambers (which has offices in London and Singapore). She specialises in commercial, banking, insurance and aviation cases, and has worked on numerous high-profile instructions, including the FCA business interruption insurance test case proceedings. She has been in practice for 20 years, having first worked as a litigation solicitor at King & Wood Mallesons in Melbourne and then at Freshfields in London, before completing BCL, MPhil and DPhil degrees at the University of Oxford, and then joining the London Bar in 2010. She is the author of a number of published works, including a book on letters of credit and demand guarantees, as well as a chapter in The Law of Bank Payments, and numerous articles.

GST Rate Change
The Singapore Government has announced that the Goods and Services Tax (GST) rate will be increased from 7% to 8% with effect from 1 Jan 2023. All invoices issued in 2023 will be subject to the prevailing GST of 8%. All 2022 billings will reflect 7% and must be paid in full by 31 Dec 2022, failing to do so might result in the re-billing of course fees in 2023, at the prevailing GST of 8%. |
