How the JD programme prepares lawyers for a global economy

Prior to the pandemic, the legal practice has already been grappling with disruptions caused by the exponential growth of technologies that have revolutionised our lives, jobs, and interactions. The use of technology in the legal sector is changing the nature of legal work, and the pandemic has only accelerated this transformation.

In such tumultuous times, there is a greater need for legal experts with a thorough grasp of business practices and the rapid developments in a digital economy. The SMU Yong Pung How Juris Doctor programme (‘JD’), a law degree for students who have undergraduate degrees in other disciplines and those who have studied law, bears the University's traits of holistic learning, active seminar-style pedagogy and international and practical exposure. As such, the programme attracts students from around the world with its strong reputation and diverse student community.

Currently the only Japanese attorney fully qualified to practice all areas of Singapore law without any restriction, SMU JD graduate Takehiro Miyoshi had always wanted to practise law in our city-state.

"Singapore is well-known as a financial hub with high standards of security and has a strong reputation as a clean city," says Takehiro, who now has permanent residency in Singapore.

“Prior to pursuing my studies at SMU, working in a foreign financial institution was one of my dreams."

Takehiro worked at Barclays Capital and had graduated from Cornell University in the US with a Master of Public Administration (concentration in Economic and Financial Policy). Having shortlisted Singapore as a hub for building his legal career, he visited various universities here and was drawn to the SMU admissions staff who were friendly and helpful. Moreover, the JD programme provides students with the opportunity to integrate practical expertise with theory and doctrine. A distinctive feature of the programme is that lawyers from practice, the government sector and the judiciary will be invited to participate in classroom teaching.

"The JD programme in SMU teaches not only theory but also the practical aspects of law," says Takehiro.

"Since many students have years of working experiences before entering the programme, they raised many questions they faced in real life which led to many fruitful discussions. Thanks to these sessions, I was better prepared after graduation to advise my clients on the practical aspects of the law, considering their business needs."

Today, he handles a wide range of cases including criminal and family law issues and lawsuits, and serves as a nominee director and a company secretary of many companies. Takehiro's career progression also reflects how JD graduates are highly sought after by the employment market, which is a testament to the effectiveness of the programme’s curriculum and pedagogy.

His current role provides the much-needed exposure to global markets and common law jurisdiction. Singapore's legal system is rooted in English law and practice, as a Commonwealth country. It has inherited the English common law traditions, particularly in contract, tort, and restitution, adopted among other Commonwealth nations.

"If I wish to work in other countries, especially Japan, I should be able to bring to the table valuable insights into legal industries around the world, as not many Japanese lawyers have experience in common law jurisdictions, let alone the attendance of hearings in the Court of the common law jurisdiction," shares Takehiro.

"Also, there are many contracts executed between foreign countries and Japan. Companies usually opt for Singapore Law as a governing law and the Singapore International Arbitration Centre as the venue for dispute resolution for its fairness and efficiency."

Takehiro recalls many memorable experiences during the programme. A particular class stood out for him: the first session for tort law, the branch of the law that delves into civil law, including lawsuits. Professor David Smith had requested several students to stand in front of the class and assigned each of them a role in a skit. Then, he described how tort law is employed in various scenarios. To this day, Takehiro is reminded of the class whenever he advises a client on tort law issues. Furthermore, through such interactive lessons, Takehiro found the confidence to speak up in English, which is not his native language.

" SMU’s law programmes provide well-balanced curriculums and the flexibility to enter into a field of your choice," says Takehiro.

"It is very interesting to see how laws are drafted and applied, and how fast laws can change and be enhanced in Singapore to tackle the issues in the society that is changing faster than ever before. I verily believe that there are so many things to learn not only for a lawyer but also for people from other occupations such as government agents and researchers."

このような激動の時代に、デジタル経済における商慣行と急速な発展を完全に把握する法律専門家への需要が高まっています。SMUヨン・プング・ハウ法務博士プログラム（以下、「JD」）は、他の学科の学士号を持つ学生や、法律を学んだことがあり、当学のホリスティック教育、活発なセミナースタイルの教授法、国際的で実践的な環境を好む方向けの法律の学位です。高い評判を誇り、多様な学生グループを擁する当プログラムは、世界中の学生を引き付けています。

現在、シンガポール法の全分野において業務を行う十分な資格を持つ唯一の日本人弁護士でありSMU JDの修了生である三好健洋さんは常に、この都市国家で弁護士になりたいと考えていました。

「シンガポールは、セキュリティ基準の高い金融ハブとしてよく知られており、清潔な都市としても高い評判を得ています」と、今ではシンガポールの永住権を持つ三好さんは話します。

「SMUで学業を進める前は、海外の金融機関で働くことが私の夢の一つでした」。

三好さんはバークレイズ・キャピタルでの勤務経験があり、アメリカのコーネル大学を卒業し、行政学修士号（経済・財政政策専攻）を取得していました。法律家としてのキャリアを築くための拠点としてシンガポールを最終候補に選んだ三好さんは、この国の様々な大学を見学し、親切で頼りになるSMUのアドミッションオフィスのスタッフに引かれたのです。さらに、SMUのJDプログラムは、実践的な専門知識を理論や原則と統合できる機会を学生に提供しています。当プログラムの際立った特徴は、開業弁護士や政府弁護士、裁判官がクラスに招かれ教育に参加することです。

「SMUのJDプログラムは、理論だけでなく、法律の実務面も教えてくれます」と三好さんは話します。

「多くの学生はこのプログラムに入る前にすでに何年もの勤務経験があるため、実際の仕事で直面した問題について多くの質問をし、それが多くの有意義な議論につながりました」。そのようなセッションのお陰で、私は修了後に、クライアントにそのビジネスニーズを考慮して、法律の実務面でのアドバイスを提供する際に、十分な準備が整っていたのです」。

現在、三好さんは刑法や家族法の問題など、幅広い案件を手掛けており、多数の企業の指名取締役や総務部長を務めています。三好さんのキャリアの進展は、JD修了生が雇用市場においていかに人気が高いかを示すものでもあり、当プログラムのカリキュラムと教授法の有効性の証明といえます。

三好さんは現在の任務により、切望していた、世界市場およびコモンロー管轄区域での経験が得られています。イギリス連邦の国家であるシンガポールの法律制度は、イギリスの法律と慣行に根差しています。他のイギリス連邦国家でも導入されているように、特に契約、不法行為、補償の分野において、イギリスのコモンローの伝統を受け継いでいます。

「私は他の国でも働きたいと思っています。特に日本です。日本の弁護士でコモンロー管轄区域での経験を持つ人は多くありません。まして、コモンロー管轄区域の裁判所の審理に参加したことがある人はほとんどいないでしょう。私は世界中の法曹界についての有益な見識を日本で提供できるはずです」と三好さんは述べています。

「また、外国と日本の間では多数の契約が履行されています。企業は多くの場合、公正さと効率性を理由に、シンガポール法を準拠法とすることを選び、シンガポール国際仲裁センターを紛争解決の場にしています」。

三好さんには、プログラム在籍中の沢山の忘れられない体験があります。彼にとって特に印象に残っているクラスは、法律の一分野である不正行為法に関する最初のセッションであり、訴訟を含む民法について研究するものです。David Smith教授が何人かの学生をクラスの前に立たせ、各学生に寸劇の役割を与えました。次に、教授は様々なシナリオにおいて、どのように不正行為法が用いられるかを説明したのです。今日に至るまで、三好さんは不正行為法の問題についてクライアントにアドバイスする度に、そのクラスのことを思い出します。さらに、そのようなインタラクティブな授業をとおして、三好さんは自分の母語でない英語ではっきりと主張することに自信を持てるようになりました。

「SMUの法務プログラムは、バランスの良いカリキュラムと、自分の選択した分野で活躍するための柔軟性を提供してくれます」と三好さんは言います。

「法律がどのように起草・適用されるか、そしてかつてない速さで変化する社会の問題に取り組むために、シンガポールの法律がいかに迅速に改定・改善されるかを学ぶのは非常に興味深いことです。弁護士だけでなく、政府職員や研究員などの職業の人にとっても、非常に多く学ぶところがあると確信しています」。
