Meeting the legal needs of today’s globalised economy

Singapore is a consummate melting pot of people and cultures. Its status as a gateway to Southeast Asia and the world's most meticulously planned city is a magnet for top global PMETs. The hyper-developed metropolis also continues to rise the ranks as a global legal hub — it is home to over 130 international law firms and is committed to becoming a leader in legal tech.

It’s little wonder then that the SMU Juris Doctor (JD) Law Degree programme — a professional law degree for students who have undergraduate degrees in other disciplines or have studied law in civil law countries and other jurisdictions — boasts a diverse student body, most of whom having extensive work experience.

"I wanted to focus on international commercial arbitration after graduating from law school, and Singapore was the destination to fulfil my dream," says Mimi Ahn, a JD graduate and one of just a handful of Koreans fully qualified to practise Singapore law.

“Unlike most other law students, I already knew that I wanted to join the field of international commercial arbitration before going to law school because of my moot experience and exposure to international arbitration practitioners.”

After all, the Associate Director at Focus Law Asia had attained Bachelor's and Master's degrees in International Relations and attended conferences as a student where she learnt about the Singapore International Arbitration Centre (SIAC) from international arbitration practitioners. Our little red dot recently made history by topping the 2021 international arbitration survey by the Queen Mary University of London and global law firm White & Case. The method of dispute resolution is an alternative to court litigation to resolve cross-border disputes.

"Since Singapore is often chosen as a seat of arbitration, I would have greater exposure to arbitration work in Singapore as compared to other countries, and at the same time maintain my ties with Korean practitioners given the proximity of the nations," adds Mimi.

While she has since represented clients in international arbitration in major arbitration venues like New York and regularly appears in the Singapore High Court for various civil, criminal and commercial cases, being a legal eagle was not always part of Mimi's career ambitions. Instead, she had always wanted to work in an international organisation — which explained her studies in International Relations. However, her MA programme at Yonsei University, one of the top private universities in Seoul, piqued her interest in law. There, she had the opportunity to take on international law electives and "things changed after I participated in international moot competitions", recalls Mimi.

“After the semester was over, several law students who took the same class as I approached me to join them in an international moot competition in Hong Kong during our summer vacation,” she reveals.

"I spent the entire summer preparing for the moot competition with my team, which included drafting written submissions and preparing for oral submissions."

After being coached by law professors and international arbitration practitioners, her team achieved an outstanding result and made it to the semi-finals, during which she received the Best Oralist Award. She then participated in multiple international moot competitions and decided to further her studies in the legal field by enrolling in the JD programme in 2011.

Upon graduation, she felt it was important for newly qualified lawyers to gain Post Qualified Experience in the jurisdiction in which they were called, without which their practising licence from the jurisdiction would “become meaningless”. This year marks the eleventh she has spent in Singapore.

“Luckily, during my training contract period, I was offered a position as a junior associate in an international arbitration team,” shares Mimi.

“Many businesses between Korea and Singapore require Singapore legal advice like construction, shipping, cryptocurrency and other commercial contracts, and there are only a handful of Koreans able to provide such advice in Korean as one needs to be qualified to practise Singapore law.”

Furthermore, as a Commonwealth nation, Singapore's legal system has its roots in English law and practice. Therefore, lawyers educated and trained in Singapore are familiar with Singapore law and English law, both of which are often chosen as the governing law of many commercial contracts involving Korean parties.

Mimi also remarks that the SMU JD programme formed the foundation of her practice. The curriculum covered the essential theoretical aspects of each area of law encountered in her line of work. Years into her career as a lawyer and legal advisor to the Embassy of the Republic of Korea in Singapore, she continues to apply her learnings in the specificities of the cases she takes on.

The main highlight of her JD education? An experiential approach that helps develop confidence and analytical and presentation skills — essential attributes for thriving in the legal and corporate world. Also, the Korean national credits the international faculty — whose journal articles and books are often cited in Singapore Courts, for bringing with them a wealth of practical knowledge into the classroom.

“Because I was a mooter, I participated in moot competitions organised by law firms in Singapore,” says Mimi.

"This was a way for me to meet local practitioners. Group projects were also one of the highlights at SMU that required students to cooperate and bounce off ideas. I was able to make friends quickly and learned a lot from different classmates."

Her advice to Korean students thinking of applying for law schools in Singapore: First, English proficiency is important not only to make it in law school but also to practice law in Singapore with other local practitioners. Second, Korean students should be prepared to learn from and adapt to the local culture, especially if they are considering pursuing their career in Singapore on cross-border matters. Mimi also points out that a Singapore-qualified Korean lawyer is often required to connect between Singaporeans and Koreans. Thus, it is crucial for legal practitioners working in a global city like Singapore to adopt an open mindset in their careers.

“For me, the transition from Korea to Singapore was not difficult because there was no language barrier: Everyone speaks English in Singapore,” shares Mimi.

"Furthermore, Singapore is a safe and convenient place to live. The transition was made so much easier since the SMU campus is located at the heart of the city, which allowed me to explore other areas of the country with ease easily."

SMU 의 법학전문석사(JD) 프로그램이 다양한 배경을 가진 학생들을 자랑하는 것 역시 놀라운 일이 아닙니다. SMU의 JD 프로그램은 다른 분야에서 학사 학위를 소지하거나 대륙법 국가 및 기타 사법권에서 법학을 전공한 학생을 위한 전문 법학 학위로 학생들 중 다수는 광범위한 분야의 업무 경력을 보유하고 있습니다.

안미미(Mimi Ahn) 동문은 SMU JD 졸업생으로 싱가포르 변호사 자격을 갖춘 소수의 한국인 중 한 명입니다. 안 변호사는 "저는 로스쿨을 졸업한 후 국제중재 분야에 집중하고 싶었고, 싱가포르는 그 꿈을 이룰 수 있는 곳이었습니다"고 말했습니다.

안 변호사는 “대부분의 로스쿨 학생들과 달리 저는 로스쿨 진학 전에 모의재판 경험이 있었습니다. 실무자들도 알고 있었죠. 이에 SMU JD를 택하면서 이미 국제중재 분야에서 일하고 싶다는 생각을 갖고 있었습니다”고 했습니다.

Focus Law Asia 의 어소시에이트 디렉터로 일하는 안 변호사는 국제관계학 학사 및 석사 학위 소지자입니다. 대학생 자격으로 국제 행사에 참석하며 국제중재 실무자들로부터 싱가포르 국제 중재센터(SIAC)에 대해서도 알게 됐습니다. 이 센터는 최근 Queen Mary University of London 과 글로벌 로펌 White & Case 가 실시한 2021년 국제중재 조사에서 1위를 차지했습니다. 중재는 법원 소송을 대신해 국제 분쟁을 해결하는 대안 역할을 하고 있습니다.

안 변호사는 "싱가포르는 중재지로 종종 선택됩니다. 저는 다른 국가에 비해 싱가포르에서 중재 업무를 더 많이 접할 수 있었습니다. 싱가포르가 한국과도 물리적으로 가까운 까닭에 한국의 중재 실무자들과도 좋은 관계를 유지할 수 있었습니다"고 했습니다.

안 변호사는 뉴욕과 같은 주요 국제 중재지에서 고객을 대리했고, 싱가포르 고등법원에서 다양한 민형사 및 상거래 관련 사건을 맡아 변론했습니다. 하지만 그가 ‘법률 전문가가 되어야겠다’는 생각을 항상 했던 것은 아니었습니다. 그는 언제나 국제기구에서 일하기를 원했습니다.국제관계학을 학부 및 석사 전공을 택했던 것도 그 때문이었습니다. 그러던 그는 서울의 명문 사립대 중 하나인 연세대에서 석사 과정을 밟으면서 법학에 관심을 갖게 됐습니다. 국제법을 선택과목으로 배울 기회가 있었던 안 변호사는 “국제모의재판대회에 참가한 후에 바뀌었던 것 같아요”라고 회상했습니다.

그는 "학기가 끝난 후 같은 국제법 과목을 수강했던 학생들이 ‘여름방학 기간에 홍콩에서 열리는 국제모의재판대회에 같이 나가자’고 제안했어요"라고 했습니다.

"팀과 함께 서면 작성과 구두 변론을 준비하는 데 그 해 여름을 통째로 보냈습니다"고 밝혔습니다.

법과대학 교수들과 국제중재 실무자들의 지도를 받은 뒤 안 변호사의 팀은 준결승에 진출하는 쾌거를 이뤘습니다. 안 변호사 개인적으로도 ‘최우수변론가상(Best Oralist Award)’을 받았습니다. 이후 그는 다수 국제모의재판대회에 참가했고, 2011년 SMU JD 프로그램에 지원해 본격적으로 법학을 공부하기로 결심했습니다.

졸업 후 안 변호사는 싱가포르 변호사시험에 합격한 뒤 싱가포르에서 실무 경험을 축적하는 것이 중요하다고 느꼈습니다. 이 과정을 거치지 않는다면 싱가포르 변호사 자격을 취득한 게 무의미할 것이라고 생각했습니다. 올해로 안 변호사는 싱가포르에서 11년째를 보내고 있습니다.

“다행히 실무수습 기간 동안 국제중재팀의 주니어 변호사 자리를 제안받았습니다”고 안 변호사는 말했습니다.

그는 “건설, 운송, 암호화폐 및 기타 상거래 계약에서 다수 한국 기업과 기업인들이 싱가포르 법률 자문을 필요로 합니다. 싱가포르 변호사 자격을 갖추고 한국어로 조언을 할 수 있는 한국인은 소수에 불과합니다”고 했습니다.

싱가포르는 영연방의 일원으로서 자국 법률체계의 뿌리를 영국법에 두고 있습니다. 따라서 싱가포르에서 교육을 받고 훈련을 받은 변호사들은 여러 상거래 계약의 준거법으로 선택되는 싱가포르법과 영국법에 동시에 익숙합니다.

안 변호사는 SMU JD 프로그램이 자신의 실무역량의 기초가 됐다고 말합니다. SMU JD 교육과정은 그녀의 실무 분야에서 법률 이론적으로 필수적인 부분을 다뤘습니다. 주싱가포르 대한민국 대사관의 법률 고문으로도 활동하는 안 변호사는 자신이 맡은 사건들에 계속해서 JD 과정에서 배웠던 것들을 적용하고 있습니다.

안 변호사는 SMU JD 과정에서 가장 주목할 부분으로 자신감과 분석 및 발표 역량을 키우는 데 도움이 되는 경험적 교육 방식을 꼽습니다. 이 같은 교육법은 법조계나 재계에서 성공하기 위한 필수 역량입니다. 훌륭한 교수진도 빠뜨릴 수 없습니다. SMU 법과대학 교수진들의 논문과 저서는 싱가포르 법원에서 자주 인용되고, 그들은 풍부한 실무 경험 및 지식을 강의에 접목합니다.

안 변호사는 “싱가포르의 로펌들이 주최하는 모의재판대회에 참가했다”고도 말했습니다.

"대회에 참가하면서 실무를 하는 변호사들을 만날 수 있었습니다. 각 교과마다 진행되는 조별과제 또한 학생들이 협력하고 아이디어를 떠올려야 한다는 점에서 SMU 교과과정의 하이라이트 중 하나였습니다. 이를 통해 빠르게 친구를 사귀고, 친구들로부터 많은 것을 배울 수 있었습니다"고 했습니다.

안 변호사는 싱가포르에 있는 로스쿨에 지원하려는 한국의 학생들에게 다음과 같은 몇 가지를 조언합니다: 첫째, 영어 실력입니다. 영어실력은 로스쿨 진학은 물론 졸업 후 다른 실무자들과 함께 일할 때 중요합니다. 둘째, 한국 학생들은 현지 문화를 배우고 그에 적응할 준비가 돼 있어야 합니다. 이는 특히 한국 학생들이 국제 분쟁을 다루고자 할 때 중요합니다. 안 변호사는 또 싱가포르인과 한국인들을 서로 이어주기 위해 싱가포르의 변호사 자격을 갖춘 한국인 변호사가 필요하다고 말합니다. 싱가포르와 같은 글로벌 도시에서 일하는 법률가는 자신의 경력 개발에 있어 열린 마음과 사고방식을 갖는 게 중요하다고 조언합니다.

안 변호사는 "저는 한국에서 싱가포르로 전환하는 것이 어렵지 않았습니다. 싱가포르에서는 모든 사람이 영어를 사용하는 덕에 언어장벽이 없었습니다"고 했습니다.

"게다가 싱가포르는 안전하고 편리해서 살기 좋은 곳입니다. SMU는 학교 캠퍼스가 도시 중심부에 있기 때문에 접근성이 좋아서 싱가포르의 다른 지역들을 아주 쉽게 찾아가 볼 수 있었습니다." (안미미 동문)
