The foundation of an arbitration lies in the agreement to arbitrate. The jurisdiction of the Tribunal and the scope of its powers depend on it. The purpose of an arbitration, leaving aside strategic manoeuvrings, is an arbitral award. An arbitration agreement is therefore the genesis of an arbitration, with an award its end product. These are arguably the most important aspects of any arbitration. Most arbitration-related applications in Court turn on a consideration of an arbitration agreement and a scrutiny of an arbitral award, sometimes both as the scope of an arbitration agreement can determine the validity of an award.

This half-day course gives an overview on issues frequently encountered in relation to arbitration agreements and arbitral awards. It will provide an update on legislative changes as well as the growing body of jurisprudence developed by the Singapore Courts and cases of note from other jurisdictions. Topics covered will include multi-tier dispute resolution clauses, the proper law of an arbitration agreement, standard of proof at stay of proceedings, methods of challenging an award and when jurisdictional objections ought to be taken
